Will a loan modification hurt my credit?
Typically a person's credit has already suffered from being late on their mortgage, credit cards, or other expenses that report to the credit bureau. If you have maintained good credit scores your lender may make notations to the credit bureau that could affect your scores. However, it is possible to ask the lender as part of the loan modification not to make any derogatory comments to the three bureaus. It is also possible for them to remove something from the bureau, but it is up to your lender.

Is the lender required to modify my loan?
No, the lender is not required to make any adjustment to an existing loan. If it is a FANNIE or FREDDIE government loan they are required to follow guidelines commonly known as the "Obama plan" however it is extremely important to have your paperwork done completely and professionally.

Should I refinance or modify?
When you refinance it is required you submit new information and qualify financially with the lender, even if you are asking for a new loan with the same lender. Good credit scores are important. If you do a loan modification the same lender modifies your current terms on the loan. Good or poor credit scores are not a factor. If you refinance you will have higher costs associated with it; broker fees, escrow, notary, points, etc. some fees are added to your loan amount some are out of pocket.  If you do a loan modification the fees are smaller or even free and nothing is added to the loan amount so you are not paying fees for the life of the loan.
